Let's talk

Family law matters are among the most complex legal challenges individuals face, as they often involve not only legal intricacies but also deep emotional implications. Divorce, division of assets, child maintenance, custody and contact arrangements, or claims related to emotional harm during separation – these issues affect some of the most sensitive areas of a client’s personal life. Highly complex divorce proceedings, particularly those involving infidelity or disputes over the child’s residence and contact arrangements, require not only legal expertise but also the ability to strategically manage the case and anticipate its long-term implications. If you are seeking professional legal support in family law matters, our team is ready to be your reliable partner through this challenging period.

At Prevence, our family law specialists handle both amicable and high-conflict divorce cases on a daily basis. We represent clients in proceedings related to divorce, property division, determination of a child’s place of residence, child maintenance claims, parenting time arrangements, paternity establishment or disputes, division of marital debt, guardianship, and adoption. We also draft prenuptial and postnuptial agreements to ensure future clarity in financial matters.

Experience shows that family disputes often begin with strong emotions but can evolve into reasoned resolutions when guided professionally. In complex divorces, clients frequently look for a lawyer who can provide not only precise legal analysis, but also help them understand the long-term impact of decisions on their and their children’s lives. That is why our priority is a personalized approach – we assess each case individually, with attention to every possible consequence.

It is important to note that in Lithuania, before turning to court in family disputes, parties are required to attempt mandatory mediation. This is a compulsory out-of-court procedure, and without it, courts will not accept procedural documents. We assist our clients in preparing for mediation, selecting a qualified mediator, and supporting them throughout the entire process.

Property relations between spouses and unmarried couples

We advise clients on a wide range of issues, including divorce, division of marital assets, determination of a child’s residence, and parenting arrangements. Our team also handles complex cases involving paternity disputes, relocation of children abroad, and parental contact rights. In property matters, we assist with the identification and recognition of assets not formally registered or held in the name of third parties, ensuring they are properly included in the joint estate.

We provide assistance in drafting individualized financial agreements – including prenuptial and postnuptial contracts – to define financial responsibilities and rights within a marriage or long-term partnership.

Our experience shows that effective legal support in family disputes requires more than legal knowledge. It demands a deep understanding of personal dynamics and long-term consequences. That is why we are committed to providing legal guidance that is not only accurate and legally sound, but also respectful of the client’s personal situation and goals.

Child maintenance and custody matters

Parents’ duty to support their minor children is a fundamental legal principle, applicable regardless of whether they live together or separately. In cases of divorce or separation, both parents remain equally obligated to contribute to the child’s financial maintenance, regardless of which parent the child primarily resides with. Each parent must ensure that the child receives adequate material support in accordance with the child’s needs and the parents’ financial capabilities. If one parent fails to fulfill this obligation, the other may file a claim for child support in court.

One of the most sensitive issues during divorce proceedings is determining the child’s primary place of residence. In practice, the child usually continues to live with the parent with whom they spent the majority of time prior to the divorce; however, the final decision is always based on the best interests of the child. The court assesses the living conditions of each parent, their emotional bond with the child, and their ability to provide a stable and supportive environment for the child’s development. If the parents cannot reach an agreement, matters concerning custody and residence are resolved in court, with the involvement of the State Child Rights Protection and Adoption Service.

Our legal team provides comprehensive advice and representation in all matters related to child maintenance, custody, residence, and contact arrangements. We also assist parents in their communication with child protection authorities and help identify legally sound solutions that prioritise the child’s best interests.

Divorce and asset division

Divorce is a significant life event that often involves not only emotional challenges but also complex legal procedures. When deciding to dissolve a marriage, the first step is to assess whether it is possible to reach an agreement with the spouse on all key issues – the terms of the divorce, division of assets, the child’s residence, and financial support. If consensus is reached, the divorce can proceed by mutual consent, making the process quicker and less burdensome for both parties.

However, divorces are frequently contested – particularly when initiated unilaterally and involving disagreements over fault, compensation for non-material damage, or the division of marital property. Divorces based on infidelity or other damaging actions by one spouse often lead to prolonged and emotionally difficult litigation. In such cases, it is essential to prepare thoroughly, gather relevant evidence, and clearly articulate your legal claims.

Our legal team advises and represents clients in all divorce-related matters – whether seeking a divorce by mutual consent or navigating contentious proceedings. We have extensive experience in complex divorces involving claims for non-pecuniary damages, equitable distribution of assets, and the protection of children’s best interests.
