Freight transport contracts

In the freight transport sector, where every action has a direct impact on the supply chain, the drafting of contracts is a key element of the logistics business.

Damage, loss and late delivery of cargo

Damage, loss and late delivery are the most common risks that are encountered by parties involved in freight transport. These situations may have legal implications under contracts of carriage and other legal documents.  When cargo is delivered and damage or shortage is observed, or the cargo is delivered late, the first step is to properly record the event and notify the customer immediately. In such cases, it is very important to carefully observe the statutory (e.g. CMR Convention) limitation periods within which any deviation from the scheduled delivery condition must be notified. 

In the event of a situation where the goods are damaged during transport, the injured party must prepare a proper claim in order to obtain instantaneous compensation for the damage suffered at the lowest possible cost. The consignee should carefully document any damage, using photographs or video recordings, when the defect is discovered.

In any case, the carrier must be proactive, take active steps to record all relevant circumstances of the transport, keep all relevant documents such as the contract of carriage, loading documents, invoices, etc., in order to be able to apply the limitation of liability or to reasonably avoid liability.
