Internal investigations at the workplace: when are they worth it and what value do they bring?

Company leaders often face situations where they must quickly—but responsibly—assess whether an employee has potentially breached their duties. Does the case call for disciplinary action, or even dismissal? One of the most effective solutions is a professional, impartial internal investigation, which allows decisions to be made based on facts, not assumptions.

This was the case with one of our clients—a Lithuanian-owned company that encountered a serious internal crisis. The client turned to us uncertain whether a few employees had truly violated their duties and whether dismissal would be justified. Together, we chose not to jump to conclusions, but to follow an objective investigation path.

What did we do?

We assembled a neutral and independent investigation team—consisting of both internal and external specialists.

During the investigation, we:
• Identified and confirmed the factual circumstances;
• Interviewed employees;
• Collected and analyzed relevant documents, communication, and decision-making processes;
• Formulated clear, evidence-based conclusions.

The investigation became a cornerstone document—allowing the employer to make a well-founded, rational decision on applying disciplinary measures instead of reacting emotionally.

Legal aspects of internal investigations

🕒 When does legal liability begin?
According to court practice, an employer is considered to have “learned” about a violation not when they hear rumors, but when the internal investigation is completed. This is crucial when calculating deadlines for disciplinary measures.

⚖️ Duration and quality of the investigation
The investigation must be carried out promptly but thoroughly. A process that drags on may be seen as unjustified delay, while a rushed one may be viewed as careless or negligent.

📁 Evidence in legal disputes
An internal investigation is one of the most reliable ways to collect evidence. Its findings can serve as the basis in labor dispute commissions or court proceedings.

🤝 Strengthening internal culture
Internal investigations also help strengthen company culture—they demonstrate that decisions are made responsibly, transparently, and according to procedure. They not only resolve the immediate issue but also uncover systemic weaknesses.
